Terms of Service

1. Agreement
These terms are between you and Higher Self GmbH, Rudolfstetten, Switzerland (UID CHE-408.288.462), which operates Motivia. By creating an account you accept them.
2. Who can use Motivia
You must be at least 18. If you are using Motivia for a company, you confirm you may accept these terms on its behalf.
3. Your account
Sign-in uses a one-time code sent to your email address, or your Google account. Keep access to that email account secure — anyone who can read your email can sign in as you. You are responsible for what happens under your account. Tell us at support@motivia.ai if you think someone else has access.
4. What Motivia does
Motivia generates images, videos, music and speech from your prompts, using third-party AI models. It is available on the web at motivia.ai and as an app for iOS and Android, distributed through the App Store and Google Play; these terms apply to all of them. Generated results vary. We do not guarantee that any particular result will be produced, or that it will meet your expectations.
5. Credits and plans
Generating media consumes credits. Your plan grants a monthly allowance, and you can buy additional credit packs. Credit costs per generation are set by us and may change. Plan allowances and prices may change; we will tell you before a change affects your subscription. If a generation fails, your credits are returned automatically. Credits are not otherwise refundable and have no cash value. Unused credits do not transfer if you cancel.
6. Billing
Subscriptions renew monthly until cancelled. You can cancel at any time from your billing page — your plan then runs to the end of the period you have paid for. If a payment fails we will email you. We retry the payment for three days. If it still fails, your subscription is cancelled and your account returns to the free plan. Payments are handled by Stripe. Their terms apply to the payment itself.
7. Your content
You own what you create. We claim no ownership of your prompts or your generated media. You grant us only the licence we need to run the service: to store your content, to process it through our AI providers, and to display it back to you. That licence ends when you delete the content or your account. We do not use your content to train AI models.
8. Acceptable use
You may not use Motivia to create: - sexual content involving minors, or any content that sexualises a minor - content that depicts or incites violence, terrorism or self-harm - content designed to harass, threaten or defame a person - deepfakes or impersonations of real people intended to deceive - content that infringes someone else's copyright or trademark - content that breaks any applicable law You also may not: - resell access to Motivia without our written agreement - use bots or scrapers against the service - attempt to bypass credit limits, rate limits or access controls - reverse engineer the service or probe it for vulnerabilities We screen prompts, uploads and generated results automatically. We may refuse or remove a generation, and we may suspend or terminate an account that breaks these rules. If you see a result that breaks these rules, report it: in the app, open the result, tap ⋯ and choose Report, or email support@motivia.ai. We review reports within 48 hours.
9. Third-party AI providers
Generation is performed by third-party AI models. Their own policies apply to how they process your prompts, and their availability is outside our control.
10. Availability
We aim to keep Motivia running but do not promise uninterrupted service. We may change or discontinue features. We will give reasonable notice of significant changes where we can.
11. Liability
Motivia is provided as is. To the fullest extent the law allows, we exclude all warranties. Our total liability to you in any twelve-month period is limited to what you paid us in that period. We are not liable for indirect or consequential loss, including lost profits, lost data or business interruption. Nothing here excludes liability that cannot lawfully be excluded — including for death, personal injury, fraud, or gross negligence.
12. Consumer rights
If you are a consumer in the European Union, you have a fourteen-day right of withdrawal on a new subscription. By starting to use the service within that period, you agree we may begin performance immediately, and you acknowledge your right of withdrawal ends once the service has been fully performed. Statutory consumer rights that cannot be waived are unaffected.
13. Termination
You may delete your account at any time from your account settings, or without signing in by emailing support@motivia.ai from your account's email address — see motivia.ai/delete-account. Deletion is immediate and permanent — your media cannot be recovered. Gifts you have already sent to other people stay with them. We may suspend or terminate your account if you break these terms. Where the breach is not serious we will give you notice and a chance to fix it.
14. Changes to these terms
We may update these terms. If the change is material we will email you before it takes effect. Continuing to use Motivia after that means you accept the new terms.
15. Governing law
Swiss law governs these terms. The courts of Switzerland have jurisdiction. If you are a consumer in the European Union, this does not deprive you of the protection of the mandatory law of your country of residence, and you may bring proceedings in your local courts.
